ENVIRONMENTAL IMPACT ASSESSMENT OF CCS ACTIVITIES IN BRAZIL AND LEGAL ASPECTS
The Environmental Impact Assessment (EIA) is a necessary support for the Environmental Licensing process of activities that cause significant environmental degradation, such as Carbon Capture, Storage and Transport Activities associated with the exploration and production of gas. Based on how CCS activities are regulated by environmental policies in other countries, the present project proposes an EIA framework for the Environmental Licensing of CCS activities specific to Brazil, based on the analysis of the current legislation, institutional aspects and socio-environmental contingencies. Furthermore, the project aims to develop legal scenarios to ensure a safe and effective implementation of CCS activities, considering (i) the role of the competent regulatory authorities; (ii) the main environmental licensing requirements; (iii) definition of CO2 ownership, and; (iv) the allocation of long-term liabilities.[/vc_column_text][vc_empty_space height=”35px”][vc_toggle title=”Escopo em português” style=”square” el_id=”1509468986196-16eb94a2-d49a”]
AVALIAÇÃO DE IMPACTO AMBIENTAL DE ATIVIDADES DE CCS NO BRASIL E ASPECTOS LEGAIS
A Avaliação de Impacto Ambiental (AIA) é suporte necessário para o processo de Licenciamento Ambiental de atividades causadoras de significativa degradação ambiental, como pode ser o caso de Atividades de Captura, Estocagem e Transporte de Carbono associadas à exploração e produção de gás. Baseando-se em como as atividades de CCS são reguladas por políticas ambientais em outros países, o presente projeto propõe uma estrutura de AIA para o Licenciamento Ambiental de atividades de CCS específica para o Brasil, a partir da análise da legislação em vigor, dos aspectos institucionais e das contingências socioambientais. Ainda, o projeto almeja desenvolver cenários normativos para assegurar uma implantação segura e eficaz das atividades de CCS, considerando (i) o papel das autoridades reguladoras competentes; (ii) os principais requisitos de licenciamento ambiental; (iii) a definição de propriedade de CO2, e; (iv) a alocação de passivo de longo prazo.
